BigBen: Discard Affidavit Submitted by Prosecution Counsel, It’s Full of Heresy – Defense Counsel tells Court

Mr. Alex Ejesieme, SAN, Defense counsel to missing Anambra-based Estate Developer, Mr. Benjamin Ezenma on Friday urged the court to discard the affidavit submitted by the Prosecution Counsel, Mrs. P. N Ofoma, describing it as bundle of heresy.

Ejesieme, who spoke when the matter came up at the Anambra High Court sitting in Awka during argument on bail application for the accused persons, insisted that the affidavit would not help the court in anyway.

Three persons, Ozo Jeff Nweke, a prominent Awka indigene, Tochukwu Nwokoye Nwosu, and David Chukwuemeka Chukwunonso are facing trial in suit No. A1 /2c/2025, for allegedly kidnapping Ezemma in November last year.

According to Ejesieme, the CCTV reports, which were included in the affidavit, were not before the court and should therefore not be relied on.

The defense counsel to the second accused, Onyekachi also urged the court not to allow the prosecution to reopen the issue of amending the affidavit.

He prayed the court to reject the medical report submitted by the prosecution on the grounds that it contained key human error in the affidavit.

Responding, Prosecution Counsel, Mrs Ofoma, an Assistant Director in the state Ministry of Justice, urged the court to discountenance the bail application, insisting that the first accused person , Nweke, has not shown any reason that he cannot stand for trial.

The presiding Judge, Justice Ike Ogu adjourned hearing for bail application to March 27, 2025.
