Nestoil Wins First Bank at the Supreme Court

Nestoil and Neconde’s Appeal against the decision of the Court of Appeal disqualifying Olanipekun SAN and Muiz Banire SAN succeeds.

 

The Supreme Court held that the Receivership is being challenged so the Board of Directors can appoint counsel in relation to such challenge.

They also held that FBNQUEST Merchant Bank and First Trustees being the appointors of the Receiver/Manager in the same transaction where the Receiver’s appointed Counsel is seeking to represent the said companies will pose an anomaly in Law and raise issues of conflict of interest
