An Awka based businessman, Tochukwu Nwosu has dragged a senior Police officer, CSP Ifeanyi Iburu to court over unlawful arrest and detention.

The case, filed at the High Court of Anambra State sitting in Awka, demanded compensation of N20 million for violation of Nwosu’s fundamental rights to freedom.

Nwosu, according to the court documents filed by applicant’s Counsel of Joe O Eze and Associates, was arrested on September 4, 2024, by 10am at Kamali Phase III, behind Dubai Estate, Awka, without any justifiable reason.

He was subsequently detained inside the cell of the Police Rapid Response Squad, Awkuzu, from 10 am to 10 pm, further infringing on his rights.

Describing the arrest and detention as clear breach of Nwosu’s fundamental rights, as enshrined in the Nigerian Constitution, the Counsel accused the respondent, CSP Ifeanyi Iburu of abusing the applicant’s power and violating his rights without any lawful justification.

“We pray the court to declare the arrest and detention unlawful and award N20 million in compensation to Nwosu for the damages suffered,” the documents partly reads.
